1. Acceptance of Terms

By accessing or using SubtrackAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms constitute a legally binding agreement between you and SubtrackAI.

2. Description of Service

SubtrackAI provides AI-powered personal styling recommendations, including skin tone and feature analysis, outfit suggestions, HD outfit visualization, and passport photo generation. The Service uses artificial intelligence to analyze uploaded photos and generate personalized fashion recommendations.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to create an account.
• One account per person. Multiple accounts are not permitted.
• You are responsible for all activities that occur under your account.

4. Credit Packs and Payments

• SubtrackAI offers one-time credit packs that provide a fixed number of outfit recommendations.
• All prices are listed in US Dollars (USD).
• Free tier users receive a limited number of recommendations per month.
• Purchased credits do not expire and are non-transferable.
• All purchases are final and non-refundable. Please refer to our Refund Policy for details.
• Payments are processed securely through Dodo Payments.

5. Acceptable Use

You agree not to:

• Upload photos containing nudity, explicit content, violence, or any material that violates our content policy.
• Use the Service for any unlawful purpose.
• Attempt to circumvent usage limits, security measures, or access controls.
• Upload images of others without their consent.
• Use automated tools or bots to access the Service.
• Reverse-engineer, decompile, or attempt to extract our AI models or algorithms.
• Resell, redistribute, or commercially exploit the Service without authorization.

6. Content Policy and Moderation

All uploaded images are subject to automated content moderation. Images that violate our content policy (including nudity, explicit material, or inappropriate content) will be rejected. Repeated content policy violations (three or more) will result in permanent account suspension. Suspended accounts forfeit all remaining credits.

7. Intellectual Property

• SubtrackAI's platform, AI models, algorithms, branding, and design are our intellectual property.
• You retain ownership of photos you upload.
• AI-generated images are provided for your personal use. You may use them for personal purposes including social media profiles and personal documents.
• You grant us a limited license to process your uploaded images for the purpose of providing the Service.

8. AI-Generated Content Disclaimer

AI-generated images and recommendations are provided "as is" and are intended for informational and entertainment purposes. The AI may not perfectly represent actual clothing items, colors, or styles. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for any particular purpose, including official documents.

9. Limitation of Liability

To the maximum extent permitted by law, SubtrackAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the preceding 12 months.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

11. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion for violations of these Terms, content policy violations, or any other reason we deem necessary to protect our platform and users. You may delete your account at any time from your dashboard.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
